Purpose: The report will consider whether the Wilsden Neighbourhood Development Plan (NDP), prepared by Wilsden Parish Council under the Localism Act 2011 can be put to a local referendum and formally adopted as part of the statutory development plan for the District. The NDP was subject to several periods of public consultation and will be considered by an independent examiner to determine its compliance with Basic Conditions and other legislative requirements prior to it being put to referendum and formal adoption.

Content: The report will consider whether the Wilsden Neighbourhood Development Plan (NDP), prepared by Wilsden Parish Council under the Localism Act 2011 can be put to a local referendum and formally adopted as part of the statutory development plan for the District. The NDP was subject to several periods of public consultation and will be considered by an independent examiner to determine its compliance with Basic Conditions and other legislative requirements prior to it being put to referendum and formal adoption. Resolved –   (1)           That the submitted Wilsden Neighbourhood Development Plan, Wilsden Design Code and accompanying Policies Map (Appendices 1a, 1b and 1c) is subject to the modifications (Proposed Modifications PM1 to PM18) as set out in the Examiner’s Report (Appendix 2), together with any relevant factual changes to ensure the amended Plan is correct.   (2)           That the modified and amended Wilsden Neighbourhood Development Plan is subject to a local referendum in the designated neighbourhood area (the Wilsden Parish Council area).   (3)           That should the Plan be successful at the local referendum, the Plan should be formally made via delegated decision by the Assistant Director (Planning, Transportation and Highways) in consultation with the Portfolio Holder (Regeneration, Planning and Transport) in line with the agreed governance arrangements and within the timescales required by legislation.   To be actioned by: Strategic Director, Place   Overview and Scrutiny Committee: Regeneration & Environment   (Andrew Marshall - 01274 434050)
