Purpose: The CrossRail Phase 1A project will be subject to statutory legal process known as a Traffic Works Act (TWA) Order. The legislation is required to authorise schemes mainly for new railways or tramways in England and Wales.   Applications for TWA orders In Wales are made to the Welsh ministers through Planning and Environment Decision Wales (PEDW). Applications are made by (or on behalf of) the promoters of the scheme, in this instance Cardiff Council.   Cabinet Approval is required to begin the process and submit to PEDW and Welsh Ministers.  

Content: The CrossRail Phase 1A project will be subject to statutory legal process known as a Traffic Works Act (TWA) Order. The legislation is required to authorise schemes mainly for new railways or tramways in England and Wales.   Applications for TWA orders In Wales are made to the Welsh ministers through Planning and Environment Decision Wales (PEDW). Applications are made by (or on behalf of) the promoters of the scheme, in this instance Cardiff Council.   Cabinet Approval is required to begin the process and submit to PEDW and Welsh Ministers.   RESOLVED: that   Cabinet noted and supported the contents of this report.   Council be recommended to                                                       i.     authorise an application for the Transport and Works Act Order (TWA Order) for CrossRail Phase 1A.                                                      ii.     note that the TWA Order will confer full authority to Cardiff Council for the construction of the project and that Cardiff Council is the named applicant of the TWA Order.                                                    iii.     note that decision making capacity to authorise TWA Orders rests with Welsh Ministers via Planning Environment Decision Wales (PEDW).                                                    iv.     note that the order will also seek powers to transfer powers to another body to adopt, operate and maintain the tramway elements of CrossRail Phase 1A. Transport for Wales (TfW) is expected to be that body.                                                     v.     Delegate authority to Director of PTE (as Senior Responsible Owner (SRO) and Programme Board Chairperson) to deal with all aspects of processing and managing the TWA Order, including but not limited to the finalisation of all documentation and agreements, negotiating where necessary with any third-party objectors, and complying and dealing with any public local inquiry processes, if required.
