Purpose:

Content: Planning permission for application reference 2024/1669/01/DET was granted subject to:     i.  A section 106 agreement to secure 1.  Controlled pedestrian crossing on Argyle Street - £50,000; 2.  Monitoring of SUDS Maintenance - £10,000; 3.  SUDS Maintenance Agreement; 4.  TEMP and monitoring fee - £1,800; 5.  Open Space £39,930; 6.  Private refuse collection; 7.  Development is retained as purpose built student accommodation.   (i)  Subject to the following conditions:   1.  3 year consent; 2.  List of approved drawings; 3.  Sample of materials; 4.  Details of highway/S278 works; 5.  Details of cycle parking; 6.  Construction Management Plan; 7.  Implementation of refuse storage; 8.  No external refuse outside of the premises; 9.  Details of access control to the building; 10.  Details of CCTV; 11.  Bat box installation; 12.  Bat working method statement; 13.  Site investigations and remedial works; 14.  Statement confirming methods and findings of the intrusive site investigations; 15.  Details of the blue roof; 16.  Details of the surface water pipe under the building; 17.  Groundwater monitoring; 18.  A verification report regarding as built SUDS; 19.  Implementation of finding from acoustic assessment; 20.  Details of PV panels; 21.  Reporting of unexpected contamination; 22.  Large scale details of lightwells; 23.  Details of hard and soft landscaping including lightwells and rubbish removal; 24.  Sealed windows; 25.  Securing the amenity space within the building in perpetuity.     ii.  It was also agreed that in the event that a satisfactory section 106 agreement covering the issues raised above is not received by 31st July 2025 that the application be refused for its failure to make adequate provision in this regard contrary to Policy DEL1 of the CSUCP unless an extension of time is agreed to the satisfaction of the Assistant Director Planning in consultation with the Chair and Vice Chairs of the Planning Committee.     iii.  It was also agreed that delegated authority be given to the Assistant Director Planningin consultation with the Chair and Vice Chairs of Planning Committee to amend, add or omit conditions and heads of terms of the section 106 legal agreement, where appropriate, to ensure the application complies with relevant development plan policies and national planning guidance.
