Content: 9        BAYSGARTH SCHOOL – PROPOSAL TO EXTEND AND INCREASE CAPACITY – The Director: Children and Families submitted a report providing a summary of the responses to the formal consultation to expand and increase the capacity of Baysgarth School, and seeking approval for the extension and increased capacity of the school.                           The demand for school places in Barton had increased over the past few years due an increase in popularity and new housing developments in the area.  The council had undertaken a consultation on the option to permanently expand the school to 1200 places. The capacity of the school was increased from 900 to 1050 in September 2020 and a new extension was built on the school site.  Numbers had continued to increase in the Barton area resulting in a further extension currently being built which would increase the capacity of the school to 1200.  The new extension was due to be completed by September 2025.   The current Published Admission Number (PAN) for the school was 210 this would permanently increase to 240 from September 2026.   The Department for Education’s (DfE) Guidance Document: Making ‘prescribed alterations’ to maintained schools, Statutory guidance for proposers and decision-makers March 2025 stated that in order to admit more than 200 children, the Department for Education required the school to increase its capacity. For an increase of 25% or 200 pupils (whichever was the smaller number) the school, governing bodies and local authorities may seek to increase the number of places by following the statutory consultation process.    The DfE guidance was followed to publish a statutory notice with a period of five weeks for representation (formal consultation).    The Local Authority either determined the proposal within two months of the end of the consultation period or the decision fell to the Schools Adjudicator.  Following publication of the decision there was a four week ‘right of referral’ where the Diocesan Board of Education of the CofE, RC Church may refer a decision made by the Local Authority decision maker to the Schools Adjudicator.   Resolved – That the proposal to extend and increase the capacity of Baysgarth School be approved.
