Purpose: To request authority to commence with formal planning enforcement action to address the harmful condition of a property within a residential area.
Content: To request authority to commence with formal planning enforcement action to address the harmful condition of a property within a residential area. The Head of Planning & Building Control is recommended to authorise: (i) The service of a notice pursuant to Section 215 of the Town and Country planning Act 1990 (ii) Further action in the event of non-compliance with the notice issued, including direct action to carry out works in default, and/or prosecution. Council Officers have entered into extensive communication with the owners of the property over several years, and have negotiated improvements through voluntary action, however the problems with the condition of the property persist, the general condition is deteriorating, and actions taken recently have fallen below the level required to address the harmful condition, including insecure boundaries which is attracting anti-social behaviour, so formal action is now considered necessary.
