Purpose:

Content: The Assistant Director of Regeneration and Place has decided to appropriate from recreational purposes to educational purposes the area of public open space adjacent to the Riverside Primary School, Brighton Street, Seacombe, Wirral, CH44 6QW edged red on Appendix 3 to this notice pursuant to section 122 of the Local Government Act 1972. The school rebuilding programme funded by the Department for Education carries out major rebuilding and refurbishment projects at schools and sixth form college buildings across England, with buildings prioritised according to their condition. Bids were submitted for four Wirral schools to be included in this programme, and it has been confirmed that Riverside and Mosslands have been accepted. The plan is for a new school to be built on the current site of the Riverside Primary School, Brighton Street, Seacombe, Wirral, CH44 6QW. This necessitates the full decant of the existing school into a temporary full accommodation facility located on and within the site (as set out in Appendix 2). Currently the site area has a recreational provision with 2 de-commissioned bowling greens which are fenced off as set out in Appendix 1). Following completion of the new school build the school will fully decant into the newly built permanent provision. It is intended that the temporary school provision within the blue coloured area on the plan in - Appendix 3, will cease and that area will revert to Public Open Green Space, with scope for future development by the Council’s parks service. The remaining red edged area (“the Site”), being land located adjacent to part of Toronto Street and Demesne Street, Seacombe as set out in Appendix 3, will be retained for educational use, given this additional area will form part of a compliance requirement under Building Bulletin 103: Area Guidelines for Outdoor Physical Education space within New Build 1 Form Entry Mainstream Schools. In accordance with Section 122 of the Local Government Act 1972 the Council may appropriate land from one purpose to another, when it is no longer required for the purpose for which it was previously held. Extending the school boundary to incorporate the Site and appropriating it for educational use will enable the Council to meet future educational demands. Having regard to the fact that no substantive objections have been received following the advertisement requirements of section 122 of the Local Government Act 1972 being fulfilled the Assistant Director of Regeneration and Place has taken the decision to appropriate the Site from recreational purposes to educational purposes. Alternative locations of the school were carefully considered and discounted for practical reasons   The decision has been taken under Part 3 Section C - Overview and Scheme of Delegations of Authority to Officers as the decision is not reserved to a Committee or Sub-Committee and the Assistant Director is satisfied that paragraphs 2(a) to 2(c) apply   Background Papers   Approval to Consult for Demesne St/Toronto St Appropriation - ODN FOR RIVERSIDE APPROPRIATION
