Purpose: To seek approval to issue tenders and delegation of authority to enter into the necessary contractual arrangements using multiple suppliers to carry out Compliance based activities. These include all statutory requirements for testing and monitoring, ensuring our buildings are safe and legal.

Content: RESOLVED   KEY DECISION   That the Executive:   a)        Confirmed the recommended procurement route, using both established framework agreements and the open market for contract(s) using multiple providers for a Statutory Compliance service.     b)      Delegated authority to the Assistant Director of Assets and Environment, in consultation with the Executive Member for Highways, Transport and Assets, to enter into the necessary contractual arrangements to secure best value for delivering the Statutory Compliance Service.    Reasons for Recommendations:   i)          The proposed procurement route seeks to widen the tender process allowing current local providers to bid, where local building knowledge may be beneficial.  Where this is not required, framework options will be utilised.    ii)         The recommendation aims to provide the most cost effective and efficient solution, which can be deployed to suit the changes in service need and delivery throughout the contract period.    iii)        The proposed option aims to access a reliable statutory compliance service provision enabling a robust process to monitor contractor performance, providing quality services for North Northamptonshire residents.    iv)       The proposed contract documentation will allow flexibility to add and remove the buildings covered by the contract as the Council’s estate evolves and the Corporate Landlord Model is implemented.   Alternative Options Considered:   ·                Current procedures include inherited legacy contracts, where most are in a “rolling” state.  These are inefficient and prevent robust contract management and budget forecasting.      ·                A total statutory compliance contract by one provider via a framework was considered.  Although, this would be beneficial as the timeframe for procuring these services is reduced, it would prevent the use of local providers, where their expertise, local knowledge and access to local markets will be highly beneficial to the procurement and ongoing contract.
