Content: Under the Leasehold Reform Act 1967, a leasehold property owner has the statutory right to either extend the length of their existing lease or to purchase the freehold title to their property.   Approval is requested to dispose of the freehold interest in 7 Dale Road, Herringthorpe, Rotherham, S65 3BZ       ROTHERHAM METROPOLITAN BOROUGH COUNCIL   RECORD OF OFFICER NON-EXECUTIVE DECISION     Date of Decision:   12th September 2025 Title: Disposal of Freehold Interest in 7 Dale Road, Herringthorpe   Decision Maker: (Including Job Title) Kevin Fisher, Assistant Director Property & Facilities Services   Details of Specific Committee Delegation or Delegation contained in the relevant Sub-Scheme of Delegation.   Decision taken under the powers granted to the Property Officer under section 29.12 & 42 of the Council’s Financial Procurement Procedure Rules (Appendix 5 of the Council’s Constitution).   Paragraph 29.12.1 states where the estimated disposal value is less than £100,000 the Property Officer, having taken financial and legal advice, may arrange for the disposal of land or property.   Paragraph 42, delegates disposals and the negotiation of terms of disposals to the Council Property Officer   Decision: That the Assistant Director for Property & Facilities Services approves the disposal of the freehold interest of 7 Dale Road, Herringthorpe to the current leaseholder under the Leasehold Reform Act 1967, in consultation with the Council’s Cabinet Member for Finance and Community Safety.   Reasons for the Decision: The leaseholder has contacted the Council requesting to purchase the freehold title in the property The Leasehold Reform Act Calculator was used to calculate the value of the freehold title. The leaseholder has agreed to pay the amount, and the councils legal and surveyors fees.
