Content: Speakers – Mr Mick Jackson (Objector)                   Mr Gary Doyle (Applicant)   Applicant – Mr Gary Doyle   Location and Proposed Development – 14 D Pinewood, Livesey, Blackburn BB2 5AD   Change of use from retail shop to a micropub with external condensing units and associated internal works.   Decision under Town and Country Planning Acts and Regulations –   RESOLVED – Approved subject to the conditions highlighted in the Director’s Report.   It was recommended that Condition No 6 be modified to read:   (6) There shall be no live or amplified music from within the premises.   REASON: In order to secure satisfactory levels of residential amenity, in accordance with the requirements of Policy DM02 of the adopted Blackburn With Darwen Borough Local Plan 2021-2037 and National Planning Policy Framework.”   And impose the following additional conditions:   Prior to commencement of the operational use hereby approved, a Noise Management Plan shall be submitted to and approved by the local planning authority.   The approved measures shall be implemented in full prior to the commencement of the approved use and shall thereafter be retained.   REASON: In order to secure satisfactory levels of residential amenity, in accordance with the requirements of Policy DM02 of the adopted Blackburn With Darwen Borough Local Plan 2021-2037 and National Planning Policy Framework.   Deliveries by commercial vehicles, disposal of waste on site and collection of trade waste shall only be made to or from the site between 09.00 – 17.00 hours Monday to Saturday, and at no time on Sundays or Bank Holidays.   REASON: In order to secure satisfactory levels of residential amenity, in accordance with the requirements of Policy DM02 of the adopted Blackburn With Darwen Borough Local Plan 2021-2037 and National Planning Policy Framework.   No area for outside drinking or seating shall be created at the site and no chairs and/or tables shall be placed outside at any time.   REASON: In order to secure satisfactory levels of residential amenity, in accordance with the requirements of Policy DM02 of the adopted Blackburn With Darwen Borough Local Plan 2021-2037 and National Planning Policy Framework.   Prior to commencement of the operational use hereby approved, a scheme relating to the external smoking area, including siting and any structures, shall be submitted to and approved in writing by the local planning authority. The approved measures shall be implemented in full prior to the commencement of the approved use and shall thereafter be retained.   REASON: In order to secure satisfactory levels of residential amenity, in accordance with the requirements of Policy DM02 of the adopted Blackburn With Darwen Borough Local Plan 2021-2037 and National Planning Policy Framework.
