Content: 3 DECISION STATEMENT FOR THE EXAMINER’S REPORT ON THE BARTON UPON HUMBER NEIGHBOURHOOD DEVELOPMENT PLAN – The Director: Communities submitted a report seeking approval for a Decision Statement outlining the council’s response to the Examiner’s Report for the Barton upon Humber Neighbourhood Development Plan (BNDP) 2024-2039, which had been subject to an independent examination. On the 28 April 2020 Barton upon Humber Parish was formally designated as a Neighbourhood Area, for the purpose of preparing a Neighbourhood Plan. Over the following years Barton upon Humber Town Council (the Qualifying Body) prepared the Neighbourhood Plan which included substantial consultation with the local community and stakeholders. The Plan and supporting documents were submitted formally to the council on the 15 November 2024. The council publicised the submitted version of the Plan and supporting documents between the 17 April 2025 and 4 June 2025 in line with the Neighbourhood Planning Regulations. In June 2025, the council, in agreement with the Qualifying Body, appointed an independent examiner to undertake an examination of the Plan following the publicity period. The examination was undertaken via written representations and included an unaccompanied site visit of the Neighbourhood Plan Area by the examiner. The Examiner’s Report was received in July 2025 and recommended that, subject to a series of proposed modifications, the BNDP met all the necessary legal requirements and should proceed to referendum. The modifications were required to ensure that the Plan met the basic conditions set out in the legislation. It was also recommended that the referendum area should coincide with the Neighbourhood Area. In accordance with the legislation, the Local Planning Authority (the council) must decide what action to take in response to the examiner’s recommendations, what modifications to make to the Plan and whether the Plan should proceed to referendum. If the council was satisfied that the Plan could proceed to referendum, it was also required to consider whether the referendum area should be extended beyond the designated Neighbourhood Area. Resolved – (a) That the Examiner’s recommendations, as set out in Appendix 1 to the report, to make modifications to the Neighbourhood Plan as detailed in the council's Decision Statement, be approved; (b) that the Decision Statement, as set out in Appendix 2 to the report, be approved and published on the council’s website, and (c) that the Barton upon Humber Neighbourhood Development Plan, as amended, proceeds to a local referendum based on the Neighbourhood Area, as set out in Appendix 3 to the report.
