Reasons for the decision The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined. The Sub-Committee took into consideration that there were 2 objections from Other Persons (local residents), and the other Responsible Authorities made no representations. The Sub-Committee took into account that the Licensing Authority had agreed with the Applicant to reduce the winding down period by 30 minutes in advance of the hearing and withdrew their objection. The Sub-Committee took into consideration the consultation issue that was administered in accordance with the Licensing Act 2003 (Premises licences and club premises certificates) Regulations 2005. There is no requirement to send notices to nearby addresses to advertise a licence application. The Sub-Committee considered the objections, and on balance after hearing the representations from the parties and considering the written representations they decided that the application would not undermine the licensing objectives. The Sub-Committee took into account that there was a significant reduction of the capacity from 300 to 100. They also took into consideration that there were no other objections from the other Responsible Authorities and that the outside area would not be used until a table and chairs licence is obtained. The Sub-Committee was satisfied that the Applicant demonstrated that the premise would be run responsibly. Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting the premises licence the licensing objectives. Public Informative The Applicant is advised to obtain a tables and chairs licence before using the outside area. The Applicant is advised to surrender the existing licence.
