Purpose:

Content: RESOLVED that the service recommends the award of a contract in the final sum of £452,816 to Borras Construction Ltd. (Company Number 01520021) “subject to contract and leaseholder consultation”. The contractor will be engaged using the JCT Intermediate Building Contract (2024) with Contractor’s Design, and the Council’s standard Schedule of Amendments. Undertake essential fire safety works, that will address risks and hazards identified in the Fire Risk Assessment and ensure residents can live safely in their homes. External and communal repairs will also be undertaken as part of this project, identified as, cavity wall insulation, balcony repairs/waterproofing electrical & decoration works. These works are necessary to ensure the Council meets its obligations to maintain the block and comply with statutory requirements. They will also contribute to reducing future maintenance needs and improve thermal efficiency. Do nothing: Withdrawing the work would result in continued deterioration of the building. While ongoing maintenance would still be required, key fire safety recommendations would remain unaddressed, exposing the Council to potential legal non-compliance with statutory obligations, including:   ·         Landlord and Tenant Act 1985 ·         Homes (Fitness for Human Habitation) Act 2018 ·         Housing Act 2004 (HHSRS) ·         Regulatory Reform (Fire Safety) Order 2005 ·         Building Safety Act 2022 ·         Fire Safety (England) Regulations 2022 ·         Decent Homes Standard   Partial or Reduced Scope: Undertaking works in phases risks non-compliance with health and safety legislation and increases overall costs due to site set ups, welfare, other contractor prelims, and management costs. A full package of works offers greater cost efficiency. None.
