Purpose: Approval is sought for the County Council to enter into a supplemental agreement under Section 106A of the Town and Country Planning Act 1990, in relation to Fylde Council planning application 24/0508 which is a mixed-use development comprising a neighbourhood centre and 58 affordable dwellings. A Section 106 Agreement for the application has already been signed dated 18th March 2025 with the Local Highway Authority securing the following contributions: • £140,000 to support public transport service improvements; and • £6000 for travel plan support. The deed of variation is a linking agreement for affordable housing provisions, which doesn’t affect the already secured highway contributions. Authority to take this decision has been delegated under the Scheme of Delegation to Heads of Service. It is recommended that the Director of Law and Governance is authorised to enter into a Section 106 agreement under Section 106 of the Town & Country Planning Act 1990 in connection with the proposed development.
