Purpose:
Content: Cabinet considered the report of the Director of Environment and Communities which sought approval of the final version of the Statement of Licensing Principles issued under the Gambling Act 2005 for adoption by Council. Members were reminded that all licensing authorities were required to publish a Statement of Licensing Principles and to review it at least every three years. It was highlighted that the draft document had been subject of a 12-week consultation process and feedback received had been carefully reviewed and minor amendments incorporated, where appropriate, in order to strengthen the council’s approach to regulation and community protection. Members noted that the revised Statement was due to come into effect on 1st April 2026. Members further noted that the revised Statement had been approved by the Council’s Licensing Committee at its meeting on 9th September 2025 and, as a statutory process, also required approval by Cabinet and Council. Councillor Stuart Bingham, Cabinet Member for Community Safety and Neighbourhood Pride, led the discussion on the item as proposer and the item was seconded by Councillor Lisa Denson, Cabinet Member for A Fairer Future. Councillor Bingham pointed out a small error in the report at section 6.1 which referred to the consultation period ending on 14th August 2022 and members noted that this should have correctly stated 2025. RECOMMENDATION TO COUNCIL: That the revised Statement of Licensing Principles issued under the Gambling Act 2005 is adopted. Reason for Decision There is a statutory process to follow before the Statement can be published and come into effect. This statutory process requires approval of the Statement by Council. Alternative Options No. The publication of the Statement is a statutory duty under the provisions of S.349 of the Gambling Act 2005. The approval process is laid down in the Local Authorities (Functions and Responsibilities) England Regulations 2000 as amended. Therefore, no other options are recommended other than what is set out in section 2 of this report.
