Content: Councillor Gist – Law and Governance Portfolio Consideration was given to proposals to adopt a Scrutiny Protocol for Stratford-on-Avon District Council. The Government’s statutory guidance on overview and scrutiny recommended councils had a protocol in place to “help define the relationship between the parties and mitigate any differences of opinion”. In receiving the report, The Cabinet noted that the adoption of a Scrutiny Protocol would provide further guidance and clarity regarding the essential remit of the Overview and Scrutiny Committee. The options available to The Cabinet were to endorse the Scrutiny Protocol, amend the Scrutiny Protocol and endorse or not endorse the Scrutiny Protocol. Councillor Crump, Chair of the Overview and Scrutiny Committee (OSC), provided feedback from the meeting of the OSC held on 30 October 2025 and proposed the following amendment: That the following sentence be added to paragraph 4.3 of the Scrutiny Protocol: “The PAPER assessment will be made available to all members of the OSC after each meeting described in paragraph 4.2.” Following which, it was RECOMMENDED to Council: (1) That the Scrutiny Protocol be adopted, as amended to include the wording above; and (2) That delegated authority be given to the Monitoring Officer to make any minor or legislative amendments to the protocol should the Government’s guidance change.
