Purpose:
Content: Councillor Gist – Law and Governance Portfolio Consideration was given to an updated Enforcement Policy that reflected changes in legislation and governance, clarified the Council’s approach to proportionate enforcement action, and incorporated new statutory guidance. In presenting the report it was noted that Appendix C had been excluded from the agenda pack but had been circulated as a supplementary document. It was noted that the revised Enforcement Policy provided the Council’s regulatory and statutory services with a strategic framework that was tailored to individual service areas, recognising that requirements may differ. The options available to The Cabinet were to approve the Enforcement Policy, or to suggest amendments to the Enforcement Policy and then approve. In receiving the report, it was noted that engagement with Town and Parish Councils was ongoing as part of the in-depth review of the Planning Enforcement Policy. It was noted that once the review had concluded, the outcome would be reported back to The Cabinet and Council. In addition, the Chief Executive outlined the reporting line and confirmed that enforcement was a Council function and not an Executive function, though performance of the service was monitored by The Cabinet. Following which, it was RECOMMENDED to Council: (1) That the updated Enforcement Policy, as detailed in Appendix 1 to the agenda report, be approved; and (2) That delegated authority be given to the Head of Law and Governance and Monitoring Officer to make any minor or legislative amendments to the Policy should the Law or Government’s guidance change.
