Purpose:

Content: The Leader introduced the report and advised that following government decision to allow the Isle of Wight to be part of the Devolution priority programme this is a need to formally consent to government laying the parliamentary order.   Alterations to the recommendations had been circulated around the room.  Firstly, it was proposed that the recommendations be taken as one vote.   Secondly, to alter recommendation 8 to read as follows:   8.               That Full Council gives delegated authority to the Chief Executive after consultation with Cllrs Jordan, Blake, Garratt, Jarman and Gladwin to agree the final form of any draft Parliamentary Order (Statutory Instrument) that the Government wishes to lay before Parliament to create a new Mayoral County Combined Authority (MCCA).   The alteration was put and duly seconded, in line with the constitution (Part 4 – paragraph 4.125) a vote was taken the result of which was:   RESOLVED:   THAT the alterations were accepted   Cllr P Spink advised that he had raised a number of procedural concerns with the Monitoring Officer relating to the item under discussion at this meeting, he asked that it be noted that he did not consider the advice received in response to be correct, however noted that he was bound by the advice provided.   Concern was raised regarding the content of the Mayoral Development Orders in particular the Local Planning Authority process and the ability of a Mayor to call in planning decisions.   Ferries had not been included as part of the functions of the Mayoral County Combined Authority (MCCA) however it was noted that this could be added once the MCCA was established.   The meeting adjourned and reconvened.   A vote was taken the result of which was:   RESOLVED   6.               That Full Council notes the summary of the draft Statutory Instrument set out in Appendix 1 and approves in principle the establishment of the Hampshire and Solent Mayoral Combined County Authority (consent to the Statutory Instrument).   7.               That Full Council notes the summary of the powers and competencies (functions) in the English Devolution and Community Empowerment Bill as set out in Appendix 2.   8.               That Full Council gives delegated authority to the Chief Executive after consultation with Cllrs Jordan, Blake, Garratt, Jarman and Gladwin to agree the final form of any draft Parliamentary Order (Statutory Instrument) that the Government wishes to lay before Parliament to create a new Mayoral County Combined Authority (MCCA).   9.               Resolve that Natalie Brahma-Pearl, Returning Officer and Chief Executive at Portsmouth City Council, is to be appointed as the Combined County Authority Returning Officer (CCARO) for the 2026 mayoral elections as outlined in the report.
