Purpose:

Content: Councillor G Cowcher – Deputy Leader – Planning and Economic Development Portfolio   Consideration was given to a response to a Notice of Motion presented to Council on 13 October 2025 which proposed the Transfer of Public Open Spaces to Private Owners.   In receiving the report, The Cabinet noted that the provisions of a Section 106 (s106) generally ran with the land. As such, any change of ownership of land covered by a s106 agreement had no bearing on the provisions of that agreement nor the ability of the local planning authority to take enforcement action for non-compliance, therefore criterion 3 had already been satisfied. It was further noted that in respect of criterion 1, 2 and 4, it was proposed that these be added to the Terms of Reference of the existing Task and Finish Group.   The options available to The Cabinet were to support the recommendations, not support the recommendation and seek to deal with matters raised separately, or not to support the Motion.   Following which, it was            RECOMMENDED to Council:   (1)       That criterion 1, 2 and 4 of the Notice of Motion be added to the Terms of Reference of the Transfer of Public Open Spaces to Private Owners Task and Finish Group, and the group report back on these issues in early 2026;   (2)       That as detailed in section 1.2 of the agenda report, criteria 3 confirmed as already satisfied, be noted; and   (3)       That the Notice of Motion be supported as detailed in recommendations (1) and (2).   Note: This item is not subject to call-in as it is a recommendation to Council
