Purpose:

Content:   (1)       That the Executive approves ‘in principle’, the making of a compulsory purchase order under Section 226 of The Town and Country Planning Act 1990 (as amended) to enable the redevelopment of the site shown edged in red on the plan in Appendix 2 to the report.   (2)       That it be noted that all costs incurred by the Council in relation to the making and implementation of a compulsory purchase order (including the acquisition costs and any compensation) would be met by L&Q, as confirmed by a proposed indemnity agreement which would be entered into by the Council and L&Q.   (3)       That authority be delegated to the Corporate Director of Place, in consultation with the Corporate Director of Governance and Community Strategy, to take all steps necessary to enable a compulsory purchase order to be made, including but not limited to the following actions: agreeing the terms and signing the indemnity agreement referred to in item (2) above; the serving of statutory requisitions for information on landowners and appointing land referencing agents; the authorisation of entry onto land for the purpose of carrying out surveys; the preparation of a draft statement of reasons; the preparation of a draft order and order schedule; and the preparation of notices to owners, lessees and occupiers, site notices and any other notices required to be served and/or advertised.   (4)       That the Executive notes that, before any compulsory purchase order is made, a further detailed report would be drafted which would seek approval from the Executive for the making of an order and which would set out the full justification for the Council using compulsory purchase order powers in this case.
