Content: 7 REVIEW OF THE OLD CROSBY CONSERVATION AREA DESIGNATION – The Director: Communities submitted a report seeking approval to begin a consultation on the future status of the Old Crosby Conservation area designation, and also to commence consultation on the implementation of an Article 4(2) Direction, removing certain permitted development rights. Conservation areas should be of special architectural or historic interest, the character or appearance of which it was desirable to preserve or enhance. The preservation or enhancement of conservation areas was secured via planning control and governed by Section 72 Planning (Listed Buildings and Conservation Areas) Act 1990. Where applications are required, the council “must pay special attention to the desirability of preserving or enhancing the character or appearance” of conservation areas. The council had a duty to review conservation areas and amend them as required under Section 69 Planning (Listed Buildings and Conservation Areas) Act 1990. Old Crosby Conservation Area was first designated in 1976, and the last review of the conservation area was completed in 2002. A re-appraisal of the current Old Crosby conservation area had recently been conducted. The review concluded that much of the architectural interest and integrity that would result in the area being classified as of “special interest” had been lost. This was through alterations to properties, some of which may have existed when the area was designated or were legal, permitted development that was not subject to planning control nor could not be controlled through planning enforcement as conservation area status alone did not provide this. The adoption of an Article 4 Direction alongside the conservation area would have provided greater protection, and an Article 4 Direction was required to bring permitted development rights enjoyed in the conservation area under planning control. In North Lincolnshire 12 of the 17 conservation areas have Article 4’s (some of which offered only partial coverage) and generally it was noticeable that the areas without an associated Article 4 were noticeably affected by damaging unsympathetic development. Approval was sought to commence a consultation exercise which proposed to remove areas of the conservation area from the designation that had lost this special character but retain the historic core of the village of Old Crosby prior to its incorporation into Scunthorpe as the town expanded. The report set out the proposed new boundary. Resolved – That Option 1, as set out the report at paragraph 3.1, be approved.
