Purpose: Further to the decision and Agreement for Sale in May 2024, where the Council approved entering into a deferred capital receipt arrangement with Regen Coulsdon, the deferred receipt long stop date has now been breached. Regen Coulsdon is now in Default of their commitment. The Council has issued a Demand Notice and Reserve of Rights letter to Regen Coulsdon on 1st December 2025.   The Council will now consider Options as set out in Part B and request approval from Mayor Perry to exercise options as set out in the recommendations. The Council will benefit from either outcome.
