Purpose:

Content: Proposal: Erection of B2 and B8 industrial building as diversification of existing business (retrospective).   The Senior Specialist Planner submitted a report which had been subject to a site visit on Monday 12 January 2026.   Slides were displayed on screen showing; location plan, planted hedgerows and trees, proposed plans – site layout, proposed elevations, view of proposed building and enclosed yard area taking from back on the site and building and access road.   The Senior Specialist Planner recommended that the application be approved subject to the conditions with the Service Manager for Development and Implementation being given delegated authority to add and/or make any amendments to the conditions as considered appropriate.   Representation:   The Ward Councillor spoke in support of the application.   The Agent spoke in support of the application.   A Member questioned if the shipping containers currently on site would be removed.   With the approval of the Chair, the agent confirmed to Members that the shipping containers would be removed.   A Member questioned conditions 3 and 4, if Natural England were to move out of the premises what would be the future use. The Senior Specialist Planner advised Members that any future occupation would have to demonstrate an operational need.   Following consideration of the application a Member moved to accept the Officer’s recommendation, this was seconded.   A vote was taken and it was unanimously agreed.   RESOLVED – That the application be approved subject to the conditions set out below with delegated authority be given to the Service Manager for Development and Implementation to add and/or make any amendments to the conditions as considered appropriate.   Conditions:   1.    The development hereby permitted shall be carried out solely in   accordance with the following plans:   PB1b Location Plan amendment received 21 October 2025 PB4 Site Plan amendment received 7 August 2025 Dwg 03 Proposed Plans received 13 November 2025 Dwg 04 Proposed Elevations PB8 Enclosed yard area received 13 November 2025 Dwg PB2 Plan Showing Existing Hedgerows and Trees received 7 August 2025 Email amending description received 7 August 2025 Fence Details received 22 September 2022   Reason: In order to ensure that the development shall be carried out in complete accordance with the approved plans and any material and non-material alterations to the scheme are properly considered.   2.    Within three months of the date of this decision full details of the surface water drainage scheme, (including a maintenance schedule) based on the hierarchy of drainage options in the National Planning Policy Guidance shall be submitted for the written approval of the Local Planning Authority. (Refer to the Cumbria Development Design Guide Appendix 7 Drainage Checklist for list of documents and evidence to be submitted).    The surface water drainage scheme must be in accordance with the Non-Statutory Technical Standards for Sustainable Drainage Systems (March 2015) or any subsequent replacement national standards and unless otherwise agreed in writing by the Local Planning Authority, no surface water shall discharge to the public sewerage system either directly or indirectly.   Any approved works shall be fully implemented within 1 month of approval and shall be maintained thereafter in accordance with the approved maintenance schedule.   Reason: To promote sustainable development, secure proper drainage and to manage the risk of flooding and pollution. To ensure the surface water system continues to function as designed and that flood risk is not increased within the site or elsewhere., in compliance with the National Planning Policy Framework and Policy S29 of the Allerdale Local Plan (Part 1), Adopted July 2014.   3.    The occupation of the unit marked A on Plan DWG03 (Proposed Plan received 13 November 2025) shall be agreed in writing with the Local Planning Authority and shall be limited to a person/s, company or organisation with a demonstrable locational requirement, in accordance S3 and S14 of the Allerdale Local Plan (Part 1), Adopted July 2014.   Reason:  The unrestricted use of the approved unit within the open countryside where a locational need has not been demonstrated would be contrary to the National Planning Policy Framework and Policies S3 and S14 of the Allerdale Local Plan (Part 1), Adopted July 2014.   4.    The occupation of the unit marked B on Plan DWG03 (Proposed Plan received 13 November 2025) shall be limited to a use ancillary to the existing lawful B2 unit at the site, or, following prior written approval from the Local Planning Authority, to a person/s, company or organisation with a demonstrable locational requirement, in accordance S3 and S14 of the Allerdale Local Plan (Part 1), Adopted July 2014.   Reason:  The unrestricted use of the approved unit within the open countryside where a locational need has not been demonstrated would be contrary to the National Planning Policy Framework and Policies S3 and S14 of the Allerdale Local Plan (Part 1), Adopted July 2014.   5.    The noise emanating from approved Unit B as shown on plan DWG03 Proposed Plan received 13 November 2025 shall not exceed NR40 when measured and assessed in accordance with BS 7445 Parts 1, 2 and 3, as measured from the monitoring point attached to the notice.   Reason: To minimise any environmental disturbance associated with the proposed development in accordance with Policy S32 of the Allerdale Local Plan (Part 1), Adopted July 2014.   6.    No power tools shall be used outside the building hereby approved. For the avoidance of doubt, the building hereby approved has both Unit A and Unit B within it.   Reason: To minimise any environmental disturbance associated with the proposed development in accordance with Policy S32 of the Allerdale Local Plan (Part 1), Adopted July 2014.   7.    Unit B as shown on plan DWG03 Proposed Plan received 13 November 2025 if occupied in association with the existing lawful B2 unit at the site shall operate solely between the hours of 8.00 am and 8.00 pm Monday to Saturday and for the avoidance of doubt shall not operate on Sundays or Bank Holidays.   Reason: To minimise any environmental disturbance associated with the proposed development in accordance with Policy S32 of the Allerdale Local Plan (part 1), Adopted July 2014.   8.    Any outside storage shall solely be confined within the enclosed yard area associated with the building hereby approved as shown on drawing number PB8 Enclosed yard area.   Reason: In the interest of preserving the visual amenity of this countryside location in accordance with Policy S4 and S33 of the Allerdale Local Plan (Part 1), Adopted July 2014.
