Purpose: The purpose of the report is to seek approval in accordance with Public Contract Regulations 2015 72.1 (a), to modify the contract with LIVV Maintenance Ltdfor Care and Repair Service by extending the contract term for an initial period of three months up to 30 April 2026. This allowed for within the existing contract at clause B1.2 which has provision to extend the contract term up to a maximum of 36 months, in aggregate.   This modification is justified as the requirements of Public Contract Regulations 2015 72.1 are met as follows:   (a) where the modifications, irrespective of their monetary value, have been provided for in the initial procurement documents in clear, precise and unequivocal review clauses, which may include price revision clauses or options, provided that such clause. (i) state the scope and nature of possible modifications or options as well as the conditions under which they may be used.

(i) state the scope and nature of possible modifications or options as well as the conditions under which they may be used.   (i)            That, in accordance with Public Contract Regulations 2015 72.1 (a), the contract with LIVV Maintenance Ltd for Care and Repair Service be modified by extending the term as provided for within the existing contract at clause B1.2from 1 February 2026 to 30 April 2026; and   (ii)        That the Procurement Team be authorised to issue the relevant contract modification documentation.   Do Nothing: This option was considered and rejected because it is strategically relevant to the Council as it helps to meet demand for low level daily living aids and, therefore, reduces demand for the Council’s occupational therapy services. Without this service waiting lists for the occupational therapy service is likely to increase, creating longer delays to people receiving support that prevents the need for more expensive long-term care.    Seek Competition (Tender): This option was considered and rejected as there were concerns that a retender would not result in any better value being offered. The proposed cost of the service has been evaluated and confirmed as offering good value to the Council.   Deliver in house: This option was considered and rejected because although the Council has the relevant skills and knowledge to do this; it does not have capacity to deliver this service. Furthermore, there is added value to an external organisation, such as a Registered Provider of Social Housing, providing this type of service in the borough which the Council would struggle to achieve on its own.
