Purpose: Under s.33 of the Localism Act 2011 (the Act) Councils are responsible for determining requests for dispensation by Members. The Council’s Constitution, Part 2 Section G (Officer Scheme of Delegation) ) and Part 4 Section B (Code of Conduct for Councillors), has delegated to the Monitoring Officer the power to grant dispensations for Members allowing them to speak and vote at a meeting when they have a disclosable pecuniary interest.
Content: Under s.33 of the Localism Act 2011 (the Act) Councils are responsible for determining requests for dispensation by Members. The Council’s Constitution, Part 2 Section G (Officer Scheme of Delegation) ) and Part 4 Section B (Code of Conduct for Councillors), has delegated to the Monitoring Officer the power to grant dispensations for Members allowing them to speak and vote at a meeting when they have a disclosable pecuniary interest. That the following dispensations be granted to all ‘dual hatted’ Members of the Council to enable them to: a. Consider and determine matters (e.g. Council Tax or local governance review) that may impact upon a Parish or Town Council when the Member is also a Member of a relevant Parish or Town Council and is therefore in a position of control or influence; and b. Consider and determine matters (e.g. local government reorganisation) that may impact upon Hampshire County Council when the Member is also a Member of that Council and is therefore in a position of control or influence. This dispensation will take effect immediately and to remain in place until May 2028.
