Purpose:
Content: To enter into and complete the legal documents listed below to formally add the next phase of land and buildings to Worthing’s Heat Network. This includes: 1. A Supplemental Deed varying the overarching Corporate Concession Agreement for the Heat Network (entered into on 28 March 2024), to add the next phase of land and buildings to the Heat Network; 2. Access Protocol for (1) Pavilion Theatre, (2) Splashpoint Leisure Centre and (3) Promenade East/West and Steyne Gardens, enabling access to the land and buildings for the installation of the pipework; 3. Connection Agreements Splashpoint Leisure Centre and Pavilion Theatre that allow the buildings to be connected to the Network; 4. Heat Supply Agreements for Splashpoint and Pavilion Theatre; 5. A Deed of Easement for Pavilion Theatre enabling installation of and ongoing repairs and maintenance for the connection pipework to the Network; and 6. Once as-built plans are submitted showing the location of the pipes laid, to enter into and complete a Main Pipeline Lease of 99 years for Steyne Gardens and Promenade East/West, and a Connection Pipeline Lease of 20 years for Splashpoint. This follows the same agreement structure as the first phase, except for the Pavilion Theatre Deed of Easement. This is because of differences with the pipeline layout. The principal terms, however, remain unchanged. This is a crucial step in delivering the next stage of the Council’s strategic low-carbon infrastructure project for Worthing (“Worthing’s Heat Network”). Not applicable.
