Purpose: To consider the award of the MK Waste Recovery Park Operator Contract to the preferred bidder.
Content: To consider the award of the MK Waste Recovery Park Operator Contract to the preferred bidder. 1. That the public and press be excluded from the meeting by virtue of Paragraph 3 (Information likely to Reveal the Financial or Business Affairs of the Authority) of Part I of Schedule 12A of the Local Government Act 1972, when the meeting considers exempt Annex B to the report. 2. That a ten-year contract (with an option to extend for a further period of five years) be awarded to the preferred bidder, as identified (ranked first) in exempt Annex B, in accordance with the published Most Economically Advantageous Tender evaluation criteria, using the competitive dialogue procedures in accordance with the prevailing Public Contracts Regulations 2015. 3. That, in conjunction with award to preferred bidder, contract award notification letters to bidders be issued, subject to the expiry of the call-in period, noting that the formal standstill period will commence as a result. 4. That a lease agreement (substantially in the form set out in Schedule 12 to the Contract) be granted for the preferred bidder and the Council to enter into a to facilitate the operation of the main contract and that authority be delegated to the Director of Environment and Property to agree any necessary but non-material amendments to the form of lease. 5. That authority be delegated to the Director of Environment and Property, in consultation with Cabinet member for Resources and Customer Experience and the Director of Law and Governance, to finalise the contract with the preferred bidder in accordance with the requirements of the competitive dialogue procurement process and to finalise the arrangements for mobilisation of the services. 6. That it be noted that any recommendation to extend this contract beyond the initial 10-year term are subject to governance arrangements contained in the Council’s Contract Procedure Rules and schemes of delegation in force at the time.
