Purpose: To approve a Deed of Variation to the Hind Street Master Development Agreement, in order to extend longstop dates to align with construction programme

Content: To approve a Deed of Variation to the Hind Street Master Development Agreement, in order to extend longstop dates to align with construction programme The Assistant Director Property and Investment has approved:   (1)  the variation of the Hind Street Master Development Agreement in accordance with the heads of terms as set out in Appendix 1 of this report; and   (2)  that the above recommendations be deemed urgent and therefore not subject to the procedure for re consideration.   REASONS FOR THE DECISION   The decision will provide time for the Council to conclude public sector grant funding agreements for the Primary Enabling Works; and complete and approve the Detailed Business Plan and any linked Gateway documentation.   The variation does not alter the MDA’s risk allocation, termination provisions or overage obligations. The variation mitigates the contractual risk of termination for non-satisfaction of time-dependent conditions.
