Purpose: i)               To confirm that the mix of purposes for which the Council’s land at Lyndhurst Road, Vigerons Way and Broxburn Drive known as “the three sites” have to date been held is no longer required; and   ii)              To agree that the three sites be appropriated for planning purposes; and iii)            That the implementation of the decision to appropriate the three sites for planning purposes shall take place immediately following the grant of consent from Secretary of State for Housing, Communities and Local Government under s 19 Housing Act 1985 for such appropriation to occur; and iv)            Following completion of the housing redevelopment, that each of the three sites be appropriated pursuant to s122 LGA 1972 for the Council to hold for long term housing purposes under the Housing Act 1985; and v)             To approve in principle the use of the s203 powers in relation to redevelopment of the three sites; and vi)            To approve the Council, through its officers, continuing to enter into negotiations with relevant owners (whose rights will be affected) to make reasonable attempts to agree compensation packages with affected rights owners prior to a final decision upon the exercise of the powers under s203; and vii)           To delegate authority to the Executive Director for Place to take all such further steps as are required to implement my decision (i) through (vi), including authority to appropriate the land for planning purposes (once Secretary of State Consent has been obtained), to approve compensation packages and to take the decision to exercise the s203 powers (provided that the criteria for doing so are met in the circumstances), and to appropriate the land back for housing purposes once the housing development has taken place.
