Purpose: Approval is sought for the County Council to enter into a supplemental agreement under Section 106A of the Town and Country Planning Act 1990, in relation to Chorley Council planning application 21/01028/OUTMAJ which is a hybrid application for a new Prison and associated works.   A Section 106 Agreement for the application has already been signed dated 18th March 2024 with the Developer being obligated to pay a sum of £1,068,000 for sustainable highway improvements.   The deed of variation is a linking agreement with there being changes to the phasing plan (application reference 25/00991/OUTMAJ), which doesn’t affect the already secured highway contributions.   Authority to take this decision has been delegated under the Scheme of Delegation to Heads of Service.   It is recommended that the Director of Law and Governance is authorised to enter into a Section 106 agreement under Section 106 of the Town & Country Planning Act 1990 in connection with the proposed development, providing for obligations on the owner or developer of the land to pay a sum of £1,068,000.
