Purpose: Cabinet is asked to authorise the making of a Compulsory Purchase Order (“CPO”) and Side Road Order (“SRO”) for the purpose of delivering the Blyth Relief Road Scheme.

Content: RESOLVED that:-   (a)     Cabinet authorise the making of a Compulsory Purchase Order (CPO) for the purpose of the Scheme and pursuant to sections 239, 240, 246 and 250 of the Highways Act 1980 (‘Highways Act’) and all other powers as appropriate to acquire the land and rights shown on the draft Order Maps (Appendix A.2) and to implement the CPO; (b)     Cabinet authorise the making of a Side Roads Order (SRO) under sections 14 and 125 of the Highways Act and all other necessary powers to improve, and stop up existing highway, construct a new highway and stop up and provide a new private means of access (PMA) as shown on the draft SRO maps and all other powers as appropriate to implement the SRO (Appendix B.2); (c)      authority be delegated to the Executive Director of Place and Regeneration to take all necessary steps, and to enter into all documentation, on behalf of the Council in connection with the making, confirmation, submission or implementation of the Orders, including in respect of service of all relevant notices, any public inquiry, appeal or legal challenge concerning the Scheme; (d)     authority be delegated to the Executive Director of Place and Regeneration to remove from the Orders any plot or interest therein no longer to be acquired compulsorily and make amendments to the Orders and other connected documents provided that the proposed amendments do not significantly alter the scope of the Orders as presented to the Committee by this Report; and (e )     Cabinet note the making of applications under section 248 and section 257 of the Town and Country Planning Act in order to stop up or stop up and divert highways as necessary that cross or enter the route of the Chase Farm Link, and stop up and divert a footpath, noting that such applications can only be made once planning permission for the Chase Farm Link has been granted.
