Purpose: This report proposes an increase of the FPN for fly tipping from £400 to the maximum permitted sum of £1000, with a reduction to £600 for early payment within 10 days, following recommendations to Cabinet from the O&S 'Addressing the incidence of fly tipping' task group. Raising the FPN will support the council’s environmental objectives, strengthen deterrence, and enhance the financial sustainability of enforcement. The early payment opportunity encourages prompt settlement and reduces administrative overheads but would still act as a disincentive to fly tipping.

Content: Councillor Simon Bridge, Street Scene, Parks and Open Spaces Portfolio Holder and Mark Billington, Director of Environment submitted a report to propose an increase of the Fixed Penalty Notice (FPN) for fly tipping following the Overview and Scrutiny's 'Addressing the Incidence of Fly-Tipping' Task Group recommendation to Cabinet: 'To consider discussing with environmental services the possibility of increasing the current fixed penalty notice of £400 for fly-tipping offences', at the Cabinet meeting held on 9 July 2025.   Councillor Bridge introduced the report.   Councillor Sir Robert Atkins expressed his support for Cabinet’s commitment to the recommendation proposed by the Addressing the Incidence of Fly Tipping Task Group. In response to a further comment regarding the implementation of the increased fixed penalty notice, Councillor Bridge emphasised the importance of robust enforcement.   Councillor Vincent also expressed his support for the increase and confirmed that it would take effect following the conclusion of the call in period.   Councillor Peter Le Marinel commended the council’s communications team for their recent social media posts highlighting fly tipping enforcement successes, and Members agreed that strong communications would be issued in respect of this decision once the call in period had ended.   Decision   Cabinet agreed:   •                  Approve the increase of the FPN for fly-tipping from £400 to £1,000.   •                  Approve the introduction of a reduced early payment rate of £600 if paid within 10 days.   •                  Delegate authority to the Assistant Director of Environmental Services to implement the new levels, update communications and embed the changes within operational procedures.
