Purpose:

Content: To exercise a contractual right under the original Sale Contract between Adur District Council and Shoreham Yacht Club to secure the transfer of a minor variation of land from the Yacht Club to the Council, at no additional cost, for the purpose of facilitating the construction of the flood defence wall.   This will be facilitated by the Parties agreeing to an amendment to the land transfer as set out in the sale contract between SYC and ADC, which now requires the transferring of an additional plot of land (of 25.95m2 which in size is approximately an adjustment of  3% in addition to the original land transferred) required for the construction and delivery of the Shoreham flood defence wall.   This land will be surrendered as a deed of transfer by SYC at a nominal cost (of £1), and the Council would cover the SYC’s reasonable legal costs for the Deed of Transfer. The land transfer is essential to enable the construction of the flood defences. There are no alternative options. The land is required in order to be able to build the flood defences.
