Location and Proposed Development: Plot 4 Land off Millbank Road/Greenbank Terrace, Lower Darwen Variation/Removal of Condition/Minor Material Amendment for Variation of Condition 2 “Approved Drawings” pursuant to planning permission 10/23/0030 (as amended by non-material amendment ref: 10/25/1352) to replan the application site to create 2 buildings for employment use (Use Classes B2, B8 or E(g) and associated landscaping) along with variation of conditions 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 16 and 21 pursuant to 10/23/0030. Decision under the Town and Country Planning Acts and Regulations – RESOLVED That planning permission be granted subject to the conditions highlighted in the Director’s report, the amended conditions in the Update Report and an additional condition relating to a Green Travel Plan: 2. Unless explicitly required by condition within this consent, the development hereby permitted shall be carried out in complete accordance with the proposals as detailed on drawings: 24.169.00-1001-P01 OS Plan 24.169.00-BA-00-DR -A-1002 Rev P10: Proposed Site Plan 24.169.00-2001-P04 Proposed Floor Plans 100 24.169.00-2001-P04 Proposed Floor Plans 24.169.00-3001-P-3 Proposed Elevations- Units A-E 24.169.00-3002-P03 Proposed Elevations-Units F-J 24.169.00-4001-P01 Site Sections REASON: For the avoidance of doubt and to clarify which plans are relevant to the consent. 4. The development shall be carried out in accordance with the approved Construction Method Statement/CEMP (Ref Nr: BDJL001 Rev:06 16th April 2026). The approved Construction Method Statement/CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details. REASON: In order to minimise harm to local ecological populations, in the interests of local ecology, and to avoid the possibility of the public highway being affected by the deposit of mud or loose materials which could create a potential hazard to road users, in order to protect the amenity of the occupiers of the adjacent properties, in order to protect the visual amenities of the locality and to comply with Policies CP6, DM15, DM27, and DM29 of the Blackburn with Darwen Local Plan 2021-2037. 6. No development shall commence (including any site clearance) within the area marked in yellow on plan titled UU exclusion zone site plan ref: 24.169.00-CPD-00-DR-A-1004 P03 until details of the means of ensuring that the water mains that are laid within and close to the site boundary are protected from damage as a result of the development have been submitted to and approved in writing by the Local Planning Authority. The developer shall submit written evidence to the Local Planning Authority that the details have been agreed with the relevant statutory undertaker. The details shall include a survey that identifies the exact location (line and depth) of the assets post completion of the development and identify mitigation measures, including a timetable for implementation, to protect and prevent any damage to the assets both during construction and post completion of the development. Any mitigation measures shall be implemented in full in accordance with the approved details and timetable and shall be retained thereafter for the lifetime of the development. In the event that the mitigating measures identify that a diversion of the water mains is required, the developer shall submit written evidence to the Local Planning Authority that a diversion has been agreed with the relevant statutory undertaker and that the diversion has been implemented in accordance with a timetable agreed with the statutory undertaker. REASON: To protect United Utilities assets/infrastructure, in the interest of public health and to ensure protection of the public water supply, in accordance with Policy DM13 of the Blackburn with Darwen Local Plan 2021-2037. 11. Full details of PTW spaces and cycle storage facilities shall be submitted to and approved by the Local Planning Authority. The approved facilities shall be implemented prior to first occupation of the development hereby approved and thereafter retained. REASON: To provide for safe sustainable travel options, in accordance with Policy DM29 of the Blackburn with Darwen Local Plan 2021-2037. 12. The proposed development shall proceed in strict accordance with the Flood Risk Assessment and Drainage Strategy by Adept, ref: 00.25137-ACE-ZZ-ZZRP-C-0001, Rev P02 dated 16th April 2026, and accompanying Drainage Strategy Plan 00.25137-ACE-ZZ-ZZ-D-C-1001 Rev P2 dated 16th April 2026 and the mitigation measures contained within. Any proposed changes to the approved GRA and/or the mitigation measures identified will require a revised GRA to be submitted to and approved b y the Local Planning Authority. REASON: To ensure that the development is not at risk of flooding and does not increase flood risk elsewhere, and that adequate measures are put in place for the disposal of foul and surface water in accordance with DM13 of the Blackburn with Darwen Local Plan 2021-2037. 16. Notwithstanding the detail shown on the approved plans, prior to the development hereby approved being first brought into use, further details shall be submitted to and approved in writing by the Local Planning Authority to demonstrate that all service vehicle movements and associated parking can be accommodated within the site. Dedicated pedestrian access routes(s) from the highway to the building entrances shall also be shown. If access gates are to be installed at the site entrance, these must be set back sufficiently to prevent vehicles from waiting or queuing back onto the adopted highways. The additional servicing detail shall include, at a minimum, details of the expected frequency of movements; the largest vehicle; and a service vehicle parking area associated with vehicles waiting to load whilst others are unloading. The servicing provision shall be implemented fully in accordance with the approved details and retained thereafter. REASON: To ensure the safe, efficient and convenient movement of service vehicles, pedestrians, and all highway users, and to ensure the free flow of traffic, in accordance with Policy DM29 of the Blackburn with Darwen Local Plan 2021-2037. 21. None of the units hereby approved shall be first occupied until a Green Travel Plan has been submitted to and approved in writing by the Local Planning Authority. The Travel Plan shall contain: · Details of a Travel Plan Co-ordinator. · Details of measures to be introduced to promote a choice of travel modes to and from the site. · A monitoring regime which sets out travel mode share targets, monitoring procedures and mechanisms to be put in place to ensure that the Travel Plan remains effective. · A timetable for the implementation, monitoring and review of the Travel Plan which shall include provision for an annual assessment (over a minimum period of five consecutive years following the implementation of the Travel Plan) of the effectiveness of the measures introduced and shall identify the need for any changes to the Travel Plan and a timetable for their implementation. The Travel Plan shall thereafter be implemented in accordance with the duly approved details and timetable contained therein. REASON: In order to promote model shift and increased use of sustainable methods of travel in accordance with the objectives of Policy DM29 of the Blackburn with Darwen Local Plan 2021-2037 and the National Planning Policy Framework.
