Purpose:

Content: *RESOLVED –   1.   That the Civil Penalties Policy, attached at Appendix 1 to the officer’s report, be approved.   2.   That the updated Private Sector Housing Enforcement Policy, attached at Appendix 2 to the officer’s report, be approved.   3.   That authority be delegated to the Director of Housing, in consultation with the Cabinet Member for Housing, to approve minor amendments to these policies in between formal review periods.   REASONS FOR DECISIONS   1.   The Renters’ Rights Act introduces a significantly expanded civil penalty framework and places new duties on the Council to enforce a broader range of landlord obligations.  To meet these requirements, the Council must ensure its relevant policies are fully aligned with the new legislative framework.   2.   Chesterfield Borough Council’s Private Sector Housing Enforcement Policy was approved by Cabinet in 2019 and now needs to be updated to reflect the new requirements. The Council does not currently have a Civil Penalties Policy and this is now necessary.
