Purpose: Delivery of Bath Quays North through delegated authority to officers to use regeneration powers, if required, under s203 of the Housing and Planning Act 2026 to facilitate the redevelopment of the site.
Content: Delivery of Bath Quays North through delegated authority to officers to use regeneration powers, if required, under s203 of the Housing and Planning Act 2026 to facilitate the redevelopment of the site. The Cabinet Member agrees to - Delegate authority to the Executive Director of Sustainable Communities, in consultation with the Leader, Chief Executive, the Council’s Section 151 Officer and Monitoring Officer, to appropriate the Bath Quays North site for planning purposes under section 122 of the Local Government Act 1972 in phases and at times the Director considers appropriate. - Authorize the delegated officer, where land is appropriated for planning purposes, to exercise the power (if required) under section 203 of the Housing and Planning Act 2016 to facilitate the redevelopment of the appropriated land. - Delegate disposal of appropriated land to the Executive Director of Sustainable Communities for the purpose of implementing development by 3rd parties. Appropriation is required to facilitate the development of the site which will create social and economic benefits. An option to take no action was considered. However, this would leave the council without a clear and up-to-date delegation framework, potentially delaying future phases of the regeneration project and increasing legal risk. None
