Content: The Sub-Committee was invited to determine an application for a new premises licence in respect of Morrisons Daily, 244 – 256 Station Road, Addlestone, Surrey, KT15 2PS. The Senior Licensing Officer presented their report; setting out the application for which the licensable activity was the off sales of alcohol only under a franchise of Morrisons. Officers advised the Sub-Committee that there were five other premises located in the vicinity which benefited from a premises licence to sell alcohol. Since submission of the application, the applicant had revised the opening hours and operational hours from a 06:00 hours start to 07:00 Monday to Sunday. Following discussions with the Police and Licensing Authority, additional conditions had been agreed, and following representations from local residents, it was also proposed that deliveries be restricted to the front of the premises. The Responsible Authorities had not made any objections to the application as a result of these agreements. Officers reported that there had been 8 valid objections to the application, a further 8 partially relevant objections had been withdrawn based on clarification of the actual activities sought and/or the changes subsequently made to the application and agreed conditions. The Sub-Committee’s attention was drawn to the Council’s Statement of Licensing Policy 2026-2031, in particular sections 6 to 11, 15, and 16, as well as the relevant guidance issued under Section 182 of the Licensing Act 2003, in particular sections 9.42 – 9.44. There were no questions posed to the Senior Licensing Officer. Therefore, the Applicant was then invited to state their case. In summary, the applicant sought to assist the community, by employing local staff and providing a modest supermarket service to local residents. The applicant had readily amended the opening hours, and accepted additional conditions. The applicant offered to further revise the terminal hour if it was deemed necessary. The applicant confirmed that spirits would be stored behind the counter, and that robust training would be in place, including adherence to the training requirements set by Morrisons for franchisees. This was regularly monitored. The two objectors attending the meeting were then invited to state their case. The priority for them was the potential for noise disturbance, anti-social behaviour, and litter. Officers advised that issues with vehicles obstructing the forecourt owing to its layout and positioning of bollards, which the residents thought could constitute a public nuisance, was not a licensing issue, but which could be taken up with the land owner. The objectors thanked the applicant for agreeing to only have deliveries to the front of the property, and they were pleased that the applicant had, in addition, to the other conditions as set out in the Appendices to the Officer’s report, undertaken to provide a bin near the entrance to the store to deter littering, and to undertake appropriate and proportionate measures to prevent nuisance from litter. There was a brief discussion between the two objectors and the applicant about the objectors’ preference for alteration to the hours for the sale of alcohol and/or hours of opening. However, it was confirmed that such an arrangement would require further discussion with Responsible Authorities with respect to an additional condition, if the opening hours exceeded those permitted for the sale of alcohol, and that the Hearing was not the appropriate forum for negotiation between the objectors and applicant. There being no further questions or comments, each party was invited to make a closing statement. The Sub-Committee resolved to exclude the press and public to determine the application at 2.35pm. The Sub-Committee reconvened at 2.50pm. Having taken into account the cases as presented, the relevant policy and guidance, as well as the written and oral representations made at the Hearing, the Sub-Committee determined that the Premises Licence should be granted with mandatory conditions and those additional conditions as agreed by the applicant. Resolved that - the application for a premises licence in respect of Morrisons Daily, 244 - 256 Station Road, Addlestone, KT15 2PS, be granted in accordance with the application as amended, subject to the mandatory conditions, and the conditions agreed by the Applicant with the Police the Licensing Authority and the Objector in Appendices F and I of the Officer’s report
