Purpose:
Content: (1) That the Executive authorises the making of a Compulsory Purchase Order (CPO) and all associated steps under the Acquisition of Land Act 1981 (pursuant to the power under section 17 of the Housing Act 1985) for the compulsory acquisition of the long-term empty property (as detailed in the exempt Appendix 1 to the report provided to Executive Members) together with its associated land, for the purposes of its renovation and reoccupation as housing accommodation. (2) That the Corporate Director of Place be delegated authority, in consultation with the Director of Legal & Governance and the Director of Finance & Systems, to take all steps necessary to enable a CPO to be made, including, but not limited to: (a) The carrying out of land referencing including serving statutory requisitions for information on landowners; and the authorisation of entry onto land for the purpose of carrying out surveys (b) The preparation of a statement of reasons; the preparation of a Compulsory Purchase Order and Order Schedule; the preparation of notices to owners, lessees and occupiers, site notices, and any other notices required to be served and/or advertised. (3) That the Corporate Director of Place be delegated authority, in consultation with the Director of Legal & Governance and the Director of Finance & Systems, to take all steps necessary to submit the Order to the appropriate Secretary of State for confirmation. (4) That, in the event of the Secretary of State returning the Order for confirmation by the Council, the Corporate Director of Place be delegated authority, in consultation with the Director of Legal & Governance and the Director of Finance & Systems, to take all steps necessary to confirm the Order. (5) That the Corporate Director of Place be authorised, in consultation with the Director of Legal & Governance and the Director of Finance & Systems, to pay compensation and statutory interest and the instituting or defending of proceedings where necessary. (6) That the Corporate Director of Place be authorised, in consultation with the Director of Legal & Governance and the Director of Finance & Systems, to take all steps necessary for the onward disposal of the property.
