Purpose: To seek approval to revise the procurement route that was approved under an individual cabinet member decision 3rd October 2025

Content: In coming to this decision I have given due and full regard to the requirements of the public sector equality duty contained in section 149 of the Equality Act 2010 (“the Act”) by reference to the law itself.   Having fully considered all the available information, I have decided to reject the alternative options and take the recommended decision to:   1.    Ratify a decision taken by Executive Director for Economy, Environment and Infrastructure to conduct a competitive procurement process in respect of a four-year, multi-supplier framework agreement for the supply, delivery and installation of:   a)    static waste compaction equipment for use at county council operated Household Recycling Centres, including an associated three-monthly maintenance service for a 5-year period (Lot 1); and b)    skips for use with the static waste compaction equipment at county council operated Household Recycling Centres (Lot 2).   This recommendation, if approved, replaces the decision taken by Lead Cabinet Member for Nature, Climate and Waste Reduction on 3rd October 2025 to procure a contract with a single provider for the delivery, installation and ongoing servicing and refurbishment of static waste compaction equipment at Hempsted Household Recycling Centre, given that subsequent development of the procurement strategy identified that a framework agreement with two lots would provide a more appropriate and efficient mechanism for meeting operational needs across the HRC network.   2.    Ratify a decision by Executive Director for Economy, Environment and Infrastructure, following the conclusion of the above procurement process, to:   a)    Appoint the preferred tenderer, namely Bergmann Direct Ltd, as the sole supplier of static waste compaction equipment and services under Lot 1 of the above framework; b)    Appoint the preferred tenderer, namely Skip Units Ltd, as the sole supplier of skips for use with the static waste compaction equipment and services under Lot 2 of the above framework.   3.    Approve the award of the following call-off contracts under the above framework agreement:   a)    A call-off contract award to Bergmann Direct Ltd under Lot 1 of the above framework relating to the supply, delivery and installation of six static compactors and a three-monthly maintenance service plan over a 5-year period at Hempsted Household Recycling centre. b)    A call-off contract award to Skip Units Ltd under Lot 2 of the above framework relating to the supply, delivery and installation of nine skips for use with the static waste compaction equipment at Hempsted Recycling Centre.   Delegate authority to the Executive Director of Economy, Environment & Infrastructure in consultation with the said Cabinet Member to progress the vital repair works at Hempsted Household Recycling centre through to completion. This will include the closure of Hempsted Household Recycling Centre to the public for approximately three months commencing in August 2026, this is now considered the optimal time with, regards to weather and resident site usage, to undertake vital works. This recommendation, if approved, replaces the cabinet member decision dated 3 October 2025 to close Hempsted for vital works in January 2026
