Purpose: To approve the commissioning of Provision of Education and Transport for Children and Young People Following Permanent Exclusion including a cohort with Education Health Care Plans award decision

Content: That the Executive Director of People/Cabinet Member:Children, Young People and Health approves the contract award, commencing on 1 August 2026, to Provider A for an initial period of two years, with the option of one further one-year extension to a maximum of three years (2+1 years) subject to satisfactory performance To complete the procurement process for a provider of education and associated transport for children and young people who have been permanently excluded from mainstream education, including a cohort with Education, Health and Care Plans (EHCPs).   Evaluation of the quality and pricing, and subsequent moderation process the Most Advantageous Tender was offered by Provider A and as such is recommended for award of contract subject to approvals. The quality responses within the tender submission were consistently strong, demonstrating a high level of assurance that the bidder understands the requirements and can deliver a safe, high-quality service. The submission also achieved the full 5% weighting for social value, reflecting a clear and well-evidenced commitment to delivering additional benefits beyond core service requirements.   The anticipated benefits delivered through awarding the contract to Provider A will include: ·       Commissioning this service will ensure continuity of education and transport for excluded pupils ·       Ensuring continuing compliance with legislation and statutory duties ·       Ensuring good quality and value for money education services which focus on meeting the needs of permanently excluded children and young people and achieving positive outcomes.   Do nothing: The Council would be unable to meet its statutory duty to provide education for permanently excluded pupils.   Spot purchase education placements or packages as and when required: Places in other Local Authority PRUs are in high demand so there will be no guarantee of places available if these are spot purchased. Bespoke packages from the unregulated market are likely to be much higher in cost if spot purchased, and so better value for money would be achieved by block purchasing.   Extend existing contract: Extending the existing contract would not be in line with procurement laws, which requires a formal competitive process to take place for a contract of this value.   None.
