Purpose: Report to abandon diversion order

Content: The Majors and Environment Team Manager introduced the report. He explained that the original order had been made in 2005 but not been progressed. The landowner still wished to divert the path, however responsibility had been transferred to Gloucestershire County Council (GCC). The report was to request authority to abandon the order, so a new order could be laid by GCC addressing previous issues.   In response to questions from Members, the Majors and Environment Team Manager explained the following: The landowner had changed since the original order, but they still wanted the path diverted. They understood that the original order had complications, and it was beneficial to clear the slate and establish a new order, The future order would be dealt with by GCC as it would fall under the Highways Act rather than the Planning Act, It was unlikely for further reports of this nature to be brought to Committee, however as One Legal previously worked with the files, there could be more.   Councillor Dutton proposed, and Councillor Watson seconded.   Councillors Dutton and Watson thanked Officers for their pragmatic approach and agreed that it was sensible to clear old orders.   On being put to a vote, the motion was passed unanimously.   RESOLVED to: a)    Abandon a public footpath diversion order Standish EST 43; and b)    Delegate Authority to Officers to serve the appropriate notices.
