Purpose: To consider proceeding with a direct award for a Design and Build Contractor, using a national framework.

Content: 1.         That the public and press be excluded from the meeting by virtue of Paragraph 3 (Information relating to the Financial or Business Affairs of the Authority) of Part I of Schedule 12A of the Local Government Act 1972, in order that the meeting consider the exempt Annex to the report. 2.         That the direct award to Bidder B, now considered the most economically advantageous from the  procurement process for the Pre-Construction Services Agreement (PCSA) stage of the design and build contract of the fourth and final Primary School on the Western Expansion Area via Government Commercial Agency RM6088 Construction Works and Associated Services Framework, be approved. 3.         That authority be delegated to the Director of Environment and Property, in consultation with the Assistant Director of Finance and Resources and the Director of Law and Governance, to: (a)        award the Construction Contract following the PCSA and subject to the cost being within the agreed budget; and (b)       conduct a new compliant procurement and award for works, should the cost not be in budget or terms cannot be agreed with Bidder B.
