Purpose: To appoint a contractor to maintain the hoarding and scaffolding at the former Beales / Co-op store Mansfield, being the site of the Mansfield Connect development
Content: Mansfield Connect - Hoarding and Scaffolding That the Design Services Commissioning Manager is authorised to award a contract via a direct award and associated aspects as detailed in the attached Exempt Appendix 1 noting that a contracts exemption form has been approved by the relevant Assistant Director. That the Legal Services Manager be authorised to finalise and complete the appropriate legal agreements, warranties and related contractual documents. On conclusion of the current contract for the soft strip, link bridges and asbestos removal contract, the former Beales / Co-op store in Mansfield town centre will revert back to the Council to maintain. The site is required to be actively managed to ensure public safety and in line with corporate insurance expectations. This site is the subject of the planned development of Mansfield Connect. The site is required to maintain the hoarding around the perimeter and the scaffolding at key points, notably along the façade of Queen Street where aspects of the building are fragile. The current contractor’s sub-contractors are engaged in the provision and the scope of the support under this report includes the costs of power and lighting, testing and inspections and appropriate licensing from Via / the Highways Authority. Design Services has been appointed by the Regeneration Manager to procure the contractor, and the Design Services Commissioning Manager has facilitated this in consultation with the Corporate Assurance Manager. The value of the contract and successful contractor are set out in the Exempt Appendix. It is exempt for publication under Paragraph 3, Schedule 12A of the Local Government Act 1972 as it contains commercially sensitive information. It is not in the public interest to release the information as to do so could jeopardize the procurement and the appointment. Due to the ongoing hire and retention of the existing temporary works/services being required urgently, procurement will be undertaken via an approved Contract Exception in accordance with the Council’s Contract Procedure Rules, allowing direct award to a suitably accredited specialist contractor to avoid unacceptable delay. In particular, the services are required so urgently as to preclude the invitation of tenders and that, in practical terms, no reasonably satisfactory alternative is available without causing unnecessary cost, disruption, delay and risk to the Council. The Council is required to manage the site on the conclusion of the contract and to be insurance compliant. Facilities Management cannot undertake this work and hence there are no other options available other than the securing of a contractor for this work.
