Content: To seek approval for the authorisation to enter into a legal Agreement under Section 38/278 of the Highways Act 1980 with Miller Homes, to carry out the proposed construction of road and footways at Parcel C, off Prescot Park Way, Prescot. Authorise the carrying out of the necessary legal and administrative procedures and to enter into an agreement under Section 38/278 of the Highways Act 1980 and Section 33 of the Local Government (Miscellaneous Provisions) Act 1982, Section 111 Local Government Act 1972 and Section 1 Localism Act 2011, with Miller Homes at Parcel C, off Prescot Park Way, Prescot, as shown on drawing number: 19001-100S38 rev H                          The option, to not enter into a Section 38/278 agreement and permit the developer to carry out the works without a Legal Agreement, has been discounted on the basis that it would leave the Council at risk, without either a bond or any quality control mechanisms to ensure that the works are completed satisfactorily and to the required standards and specification.
