Purpose: The purpose of this report is to seek approval, in accordance with Contract Procedure Rule 5.3.2(a) for the direct award of a contract to Amazon Business EU Sarl, UK. for a services contract, under the terms of YPO framework agreement 1142 – Amazon Digital Marketplace, for the period 1 December 2024 to 30 November 2027, with no option to extend.   The reason for the decision is that the framework agreement represents a compliant route to market and allows for a direct award to the supplier.  The award of a contract in this way will provide for continuity in arrangements that have been in place within the Council since February 2021 that allow for cost effective, compliant procurement activity through Amazon on behalf of the Council and provide for control/ oversight over such activity.

(i)       That, in accordance with Contract Procedure Rule 5.3.2 (a), a services contract be awarded directly to Amazon Business EU Sarl, UK. under the terms of Yorkshire Purchasing Organisation (YPO) framework agreement 1142 – Amazon Digital Marketplace, for the period 1 December 2024 to 30 November 2027, with no option to extend, for the purpose of procuring ad hoc spend in a managed and controlled manner; and   (ii)       That the Procurement Team be authorised to make the necessary arrangements for the issue of the relevant contract documentation. Do Nothing: This option was considered and rejected. The Supplier will cease to provide services if a compliant formal contract is not entered into.  This could have a potential detrimental impact on service delivery in certain circumstances if particular purchases cannot be facilitated.   Seek Competition:  This option was considered and rejected.  The framework being used for this purpose is a compliant route to market and allows for a direct award to the supplier.
