Content: Premises:                                           Winchcombe Arts and Community Hub trading as                                                                Isbourne Arts, High Street, Winchcombe, GL54 5LJ.                        Applicant:                                          Winchcombe Arts and Community Hub, trading as                                                               Isbourne Arts.   Application for a premises licence under the Licensing Act 2003.   Present:                                               Councillors P A Godwin, G M Porter (Chair) and                                                                                                    R J G Smith.   Representatives of applicant:             Chair of Trustees                                                             Proposed Designated Premises Supervisor   Responsible Authorities:                     None   Other Persons addressing the           None Sub-Committee:                                     SUMMARY OF REPRESENTATIONS   1.   No representations were received from the Responsible Authorities, although the applicant agreed to additional conditions proposed by the Police for inclusion within the Operating Schedule. 2.   Two representations had been received from other persons in relation to the application all objecting to the application.     THE APPLICATION   Relevant licensable activities and hours applied for:   Performance of Plays Every Day 09:00 – 23:00 Exhibition of Films Every Day 09:00 – 23:00 Performance of Live Music Every Day 09:00 – 23:00 Performance of Recorded Music Every Day 09:00 – 23:00 Performance of Dance Every Day 09:00 – 23:00 Entertainment of a similar description to a performance of live music, recorded music or a performance of dance Every Day 09:00 – 23:00 Sale by Retail of Alcohol Every Day 09:00 – 23:00       DECISION   Having considered the application; the evidence provided; the representations made by all parties, including those made at the hearing and the written representations of the Other Persons received who were not present at the hearing; the provisions of the Licensing Act 2003, the obligation to promote the four licencing objectives; the relevant sections of the Council’s Statement of Licensing Policy and the Statutory Guidance it was resolved that the premises licence be GRANTED in accordance with the application set out, subject to additional conditions agreed with Gloucestershire Constabulary and the additional condition imposed by the Licensing Sub-Committee.     CONDITIONS CONSISTENT WITH THOSE RECOMMENDED BY THE RESPONSIBLE AUTHORITIES AND AGREED WITH THE APPLICANT   1.      All incidents of crime must be reported to the Police. 2.      First aid equipment must be supplied on the premises. 3.      The designated premises supervisor shall ensure that tables or areas are cleared of all bottles and glasses on a regular basis during trading hours to avoid an accumulation of glassware. 4.      Staff will be trained on matters of safety, evacuation and use of emergency equipment as required - all training must be logged and dated. 5.      The 'Challenge 25' scheme shall be adopted. 6.      A log shall be kept at the premises to record all refused sales of alcohol. 7.      An incident log be will kept which will include the date, time and details of the incident that has taken place. 8.      Deliveries to take place during standard delivery hours as not to cause noise in the local area. 9.      All customers will be asked to leave quietly. 10.   Clear and legible notices will be prominently displayed to remind customers to leave quietly and have regard to neighbours.   ADDITIONAL CONDITION IMPOSED BY THE LICENSING SUB-COMMITTEE 1.      All external windows and doors must be kept closed at all times when regulated entertainment is being provided. Doors may be opened for normal entrance and egress of people but must be shut immediately thereafter.   REASON   The Licensing Sub-Committee considered that it must carry out its functions with a view to promoting the four licensing objectives, as set out in Section 4(2) of the Licensing Act 2003.  In the written representations to the Sub-Committee, the Other Persons highlighted a number of concerns in relation to potential noise nuisance, therefore, the Sub-Committee included an additional condition to alleviate those concerns.   APPEAL All parties were reminded of their rights of appeal against the Licensing Authority’s decision pursuant to Section 181 of and Schedule 5 to the Licensing Act 2003. An appeal must be made to the Magistrates’ Court and commenced within 21 days of notification of the authority’s decision.   REVIEW All parties were reminded of the procedures contained within the Licensing Act 2003 relating to the potential review of a premises licence. This provision allowed the public, businesses or Responsible Authorities to apply for a review of a premises licence where problems arose, in relation to the licensing objectives: crime and disorder, risks to public safety, public nuisance or failure to protect children from harm.
