Purpose:

Content: Adopt The Enforcement Policy for Private Sector Housing Standards to take effect from the 1st May 2026.   The Head of Housing Services and Head of Regulatory Services are to be given the delegated powers listed below:   Section 1A(1) Power to impose a financial penalty Section 1A(3) Power to determine the amount of the financial penalty   Schedule A1 Paragraph 1 Power to give notice of its proposal to impose a financial penalty under section 1A of the protection from eviction act 1977. Paragraph 5 Power to decide whether to impose a financial penalty after representations and the amount of the penalty Paragraph 6 Power to give a final notice Paragraph 9 Power to withdraw a notice of intent or final notice or reduce the amount specified in a notice of intent or final notice Renters’ Rights Act 2025 Authority Delegated Section 114(1) Power to authorise officers to give notice to a relevant person requiring the person to provide the local Housing Authority or an officer with the information specified in the notice Section 115(1) Power to authorise officers to give notice to any person requiring the person to provide the local Housing Authority or an officer with information specified in the notice Section 118(1) Power to authorise officers, at any reasonable time, to enter any premises in England if (a) the officer reasonably believes the premises to be occupied by relevant person for the purposes of rental sector business, and (b) the officer considers it necessary to enter the premises in order to exercise the powers under section 122 or 123 for purposes connected with any function of the authority under or by virtue of the rented accommodation legislation. Section 118(3) Power to serve notices on occupiers of premises Section 122 Power to authorise officers to have the power to require production of documents following an exercise of powers of entry under section 118(1) or section 120. Section 123 Power to authorise officers who have entered premises under section 118(1) or under a warrant under section 120 to seize and detain documents which the officer reasonably suspects may be required as evidenced in proceedings relating to a breach of, or an offence under, the rented accommodation legislation Section 126(1) Power to authorise specially authorised officers to enter premises in England at any reasonable time without warrant for the reasons in section 126 Section 126(2) Power to authorise officers to give notice in writing under section 126(1) (c)   3.          The Head of Service for Regulatory Services is to be given the delegated powers listed below: Renters’ Rights Act 2025 Authority Delegated Section 57(1) Power to impose a financial penalty for breach of prohibition imposed by section 56(2) or (3) Section 57(2) Power to impose an additional financial penalty Section 57(5) Power to impose financial penalty Section 66(1) Power to impose a financial penalty Section 66(2) Power to determine the amount of a financial penalty imposed under section 66 Section 83 Power to make entries on the private rented sector database Section 91(1) Power to impose a financial penalty Section 91(2) Power to determine the level of financial penalty imposed Section 108(1) Duty to notify another local authority of proposal to take enforcement action in respect of a breach of, or an offence under, the landlord legislation which occurs in the area of another local housing authority. Section 108(5) and (7) Duties to notify another local authority Section 110 Duty to report to the secretary of state on the exercise of its functions under the landlord legislation Section 113(2) and (3) Duties to notify local housing authority Section 113(6) Duty to report to lead enforcement authority Section 113(7) Power to authorise persons to exercise the powers of officers under Chapter 3
