Purpose:

Content: Cabinet approved:   a) The grant of a new 125-year full repairing and insuring lease of the Lichfield City Football Club site to Lichfield City Football Club at a peppercorn rent, subject to the inclusion of an appropriate mechanism to mitigate the potential risk of ongoing neighbouring housing developer acquiring an interest in part of the land for access purposes.   b) The transfer of the freehold of the southern half of the site at Coppy Nook Lane / Hospital Road currently owned by LDC to Hammerwich Parish Council.   2.2 Cabinet approved a 25-year extension of the current lease term to Lichfield Garrick Theatre Ltd (or appropriate alternative vehicle), at a peppercorn rent, with lease terms that provide long-term certainty while clarifying responsibilities and limiting the Council’s exposure: Repairing obligations to be shared (with the Trust assuming responsibility for lift repairs). The Garrick to assume full insuring responsibility. A £100,000 contribution from LDC towards the maintenance liabilities identified in the Planned Preventative Maintenance (PPM) assessment. The budgeted £75,000 per annum revenue funding from LDC contained in the approved MTFS is confirmed for the three years from 2027/28 to 2029/30. The permitted user clause to mirror the current lease to safeguard the theatre’s role as a community arts venue,   2.3 Cabinet did not approve the transfer of land at Christian Fields to Liberty Jamboree due to the onerous waste licence requirements.   2.4 Cabinet delegated authority to the Leader, in consultation with the Chief Executive (and the Monitoring Officer and s151 Officer as appropriate), to agree and complete all necessary legal, financial and procedural steps to implement the approved Community Asset Transfers set out in 2.1, including settling the final heads of terms and executing all associated documentation, subject to: Compliance with Section 123 Local Government Act 1972 and the General Disposal Consent (England) 2003 (and, where required, obtaining any necessary Secretary of State consent), Appropriate assessment under the Subsidy Control Act 2022 (including where applicable a subsidy control principles assessment, application of a streamlined route, or compliance with the Minimal Financial Assistance provision); Completion of all required consultations and notices (including public open space advertisement) Consideration of any objections received to the statutory consultations and determination as to whether each proposal should proceed, be amended or not proceed; and All financial implications being contained within approved budgets.
