Purpose:
Content: Following the completion of the statutory consultation period and the subsequent detailed review of all representations received, the following recommendations are presented for consideration and determination by the Cabinet Member: It is recommended that a Public Inquiry should not be held it is advised to proceed with approving and implementing the proposed orders listed below as originally proposed: · Proposed 7.5t Structural Weight Restriction on the A4077 Gilwern Viaduct. · Proposed Revocation of Prohibition of Motor Vehicles on Glynwood Road, Pontyseison, Tintern. · Proposed Time Restricted Prohibition of Driving (Term Time Only, 08:30-09:00 & 15:00-15:40) - Except for permit holders & Blue Badge holders), Harold Road, Abergavenny. The Authority received a significant number of objections and representations opposing the proposed revocation of Prohibition of Motor Vehicles on Glynwood Road (2280). Whilst these concerns are recognised and have been carefully considered, the Council has received prior legal advice that the existing Order is procedurally defective and is not sufficiently robust to be reliably enforced. Retention of the current Order would therefore expose the Council to legal challenge and uncertainty. Accordingly, despite the level of opposition received, revocation is considered necessary to establish a clear and defensible legal position and to enable the promotion of a new, legally compliant and enforceable TRO that can fully consider stakeholder concerns and deliver the intended restrictions on a robust legal footing.
